What is Maquila and How does it work?

Maquila is an investment attraction system that allows goods and services to be produced in Paraguay at the request of a company based in the UK. The finished products are then exported worldwide according to the specified requirements.

This system presents a unique opportunity for companies seeking to take advantage of a wide range of tax and duty reductions offered by the Paraguayan government, significantly enhancing their competitiveness.

The process is governed by a contract between a legally established company in Paraguay (the Maquila company) and the UK-based Head Office. The Maquila company operates on behalf of the UK Head Office, producing both tangible and intangible goods for the international market.

 

  • Head Office: Contracting company established in the UK.

 

  • Maquila Company: Contracted Company, which may be established in any part of the Paraguayan territory.

The Head Office can send capital equipment, inputs, and raw materials to the Maquila company, either directly or from any other country. These goods enter Paraguay under the temporary admission regime and may remain in the country for the duration specified in the Maquila program, which ranges from 6 months to a maximum of 1 year. Capital equipment can remain in Paraguay as long as the Maquila project is active, potentially indefinitely.

The entry of goods into the country is exempt from taxes and duties; however, a guarantee must be provided beforehand. This guarantee can take the form of a mortgage, pledge, bank guarantee, or insurance policy. The contracted company can also source goods, services, and labor within Paraguay.

Once completed, the final products are sent to any export market destination, always on behalf of the Head Office.

The output from the Maquila program can also be sold in Paraguay, limited to 10% of the export value from the previous year. The National Council of Export Maquila Industry (CNIME) must approve this sale once all temporarily suspended tariffs have been paid.

The movement of all goods under the Maquila regime is managed through a system of checking accounts that oversee temporary admission, export processing, and returns.

Who can benefit:

 

Any UK company can apply for the Maquila regime. This program is particularly advantageous for companies looking to enter the MERCOSUR market, which comprises 280 million people. MERCOSUR includes Argentina, Brazil, Paraguay, and Uruguay, along with associated members such as Chile, Bolivia, Peru, and Colombia.

Paraguay allows for the incorporation of up to 60% of extra-zone origin and 40% of regional origin to obtain MERCOSUR origin, enabling access to the entire market without tariffs.

 

For this reason, Paraguay serves as a highly convenient gateway to the Southern Common Market (MERCOSUR), of which it is a founding member

 

Available capital:

 

There are no limits or minimum requirements for capital investment. It can consist of foreign capital, local capital, or a combination of both.

 

Location:

 

Maquila industries are free to establish operations anywhere within Paraguay, with the flexibility to adapt to regional needs as required

 

Type of business:

 

Eligible businesses can be individual entities or legal entities, including corporations, limited liability companies, branches of foreign companies, or limited individual companies.

 

Field of production:

 

There are no restrictions on the type of products or services that can be produced or offered under the Maquila program.

Main Benefits

 

A single tax of 1%.

The operations under the maquila regime are exempt from all taxes related to the production process. Only a single tax of one percent is applied to the value added to the product within the Paraguayan territory.

 

VAT Recovery:

 

The maquila companies are also exempt from paying the VAT. It can be recovered in the form of Tax Credits, endorsable and negotiable.
 

Suspension of import tariffs:


The maquila regime allows companies to import raw materials, machinery and necessary supplies through a temporary admission system in which import tariffs are suspended.

 

Remittances of income and dividends abroad:

 

The maquiladora companies are exempt from paying any fee or tax on remittances of income and dividends abroad. 

 

Other additional tax exemptions include the following:

 

- Fees on documents and case files.

- Payment of fees for customs valuation service.

- Consular tariffs.

- Port fees (50%).

- All taxes, fees and contributions levied on loans intended to finance maquila operations.

 

Import Regime:

 

The maquila companies will operate under the figure Temporary Admission; which allows the entry of capital goods, raw materials and supplies into the country with the temporary suspension of the payment of tariffs and taxes, prior consolidation in the form of a mortgage guarantee, collateral, bank bond, cash and insurance policies.

Labour cost:

Labour costs are extremely competitive, with the lowest social security tax in the region.

 

Land:

Commercial land prices are very accessible. The average price of one hectare is 400 GBP in the Eastern Region and between 70 and 800 GBP in the Western Region.

Energy and Water:

Produces the cheapest electricity in South America.

Electro intensive industries have the best infrastructure to meet the requirements of technological development.

Itaipú, a binational venture with Brazil, is the world's largest hydroelectric power plant. Its installed capacity is 14000 megawatts and produces about 90000 Giga watt / hour.

Paraguay consumes only about 10% of the energy it produces, that is, it has a large amount of electricity at a very low cost.

In addition to the production of Itaipú, the Yacyreta dam built with Argentina, places Paraguay as the first 100% renewable energy exporting country in the world, free of gas emissions that produce the greenhouse effect.

 

 

Application Processess

 

Registration:

 

The National Council of the Export Maquila Industry (CNIME) is the Paraguayan entity in charge to process applications and to regulate the operations, they are directed by the Paraguayan Ministry of Industry & Trade and Finance.

 

Presentation of the Maquila Program:

 

The maquila program contains in detail the description and characteristics of the industrial process or service, schedule of imports, production, exports, job creation, percentage of added value, percentage of waste, period of time that the program will cover and others specified in the corresponding regulations. It must be accompanied by a letter of intent in case the Maquila contract is not yet available.

 

Approval by the CNIME:

The CNIME proceeds to evaluate, issue a prior opinion and communicate to the Ministries of Industry & Commerce and Finance, so that they grant their approval for the execution of the “Maquila Program” by Bi-ministerial Resolution.

 

Issuance of Bi-ministerial Resolution:

Prior approval of the CNIME and all relevant legal requirements are completed, the Bi-ministerial Resolution is prepared, which is signed by the Ministers of Industry & Commerce and the Treasury.

 

Presentation of the Maquila Contract:

From the delivery of the Bi-ministerial Resolution, the maquiladora company has a period of 120 days for the presentation of the Maquila contract. This presentation being an essential requirement to start the operations contemplated in the program.

 

Start of Operations:

Once all the requirements have been met, the maquila company starts the operations, with the supervision of the CNIME.
